Circular 04 from the National Credit Regulator regarding Consumer Profiles Checks for Employment Purposes

On 11 June 2019 the National Credit Regulator (“NCR”) issued Circular Number 4, reinforcing the compliance requirements for consumer checks for the Prescribed Purpose of Employment. This Circular requires the following documentation at the time of a consumer search and to be saved and made available for 3 years for any dispute or audit;

  1. Written consent of the prospective employee; and
  2. Job description of the position clearly outlining the requirements (honesty dealing with cash or finances).

Please note that TransUnion, Experian, Compuscan and XDS and LexisNexis will be conducting audits on a random sample of searches in the near future.  If you receive a communication that a search you have made is being audited, cooperating with a timely reply is mandatory.
